It is the intent of the Legislature that all California public schools, in kindergarten, and grades 1 to 12, inclusive, operated by school districts, in cooperation with local law enforcement agencies, community leaders, parents, pupils, teachers, administrators, and other person who may be interested in the prevention of campus crime and violence, develop a comprehensive school safety plan that addresses the safety concerns identified through a systematic planning process.  For the purposes of this section, law enforcement agencies include local police departments, and district attorneys' offices.  For purposes of this section, a "safety plan" means to develop strategies aimed at the prevention of, and education about, potential incidents involving crime and violence on the school campus

(a) Each school district and county office of education is responsible for the overall development of all comprehensive school safety plans for its schools operating kindergarten or any of grades 1-12, inclusive.

          1.  The school site council or its delegates assume the responsibility of forming a school safety planning committee

               composed of the following members.

               (a) The principal or the principal's designee.

               (b) One teacher who is a representative of the recognized certificated employee organization

               (c) One parent whose child attends the school

               (d) One classified employee who is a representative of the recognized classified employee organization

               (e) Other members, if desired.

          2.  The school site council or its delegated committee shall consult with a representative from a law enforcement                     agency in the writing and development of the comprehensive school safety plan.

The school safety plan shall include, but not necessarily be limited to the following:

  • Assess ing the current status of school crime.
  • Identifying appropriate programs and strategies that provide school safety and address the school's procedures for complying with laws on school safety:
  • Child abuse reporting procedures
  • Disaster Response (SEMS) Plan - American with Disabilities Act of 1990
  • suspension and Expulsion Policies
  • Notifying teachers of Dangerous Pupils
  • A discrimination and Harassment policy
  • School-wide Dress Code
  • Safe Ingress and Egress Procedures

    • Identify planning committee
    • Create a vision based on youth development
    • Gather and analyze data
    • Identify strengths and areas of desired change and set annual goal(s) for each of the two safe school components.
    • Identify and implement objectives and activities for each of the two safe school components.

The Comprehensive Safe School Plan shall be evaluated, and updated as need by March 1st of each year.

1.  In order to ensure compliance with this article, each school shall forward its comprehensive school safety plan to the school district or county office of education for approval.

2.  Before adopting its comprehensive school safety plan, the school site council or school safety planning committee shall hold a public meeting at the school stile in order to allow members of the public the opportunity to express an opinion about the school safety plan.

3.  The school site council or school safety planning committee shall notify in writing, the following persons and entities, if available, of the public meeting:

    • The local mayor.
    • Representative of the local school employee organization
    • A representative of each parent organization at the school site, including the parent teacher association and parent teacher clubs.
    • A representative of each teacher organization at the school site.
    • A representative of the student body government.
    • All persons who have indicated they want to be notified.

4.  The school site council or school safety planning committee is encouraged to notify, in writing , the following persons and entities, if available, of the public meeting:

    • A representative of the local churches.
    • Local civic leaders
    • Local business organization.
    • In order to ensure compliance with this article, each School District or County Office of Education shall annually notify the State Department of Education by October 15 of any schools that have not complied with Section 32281.

Key elements of the comprehensive safe school plan shall be reported in July on the School accountability report card.

Safety

The Governing Board is responsible for ensuring that proper attention is paid to the safety of students.

The Superintendent or designee shall develop and implement regulations which will ensure as safe an educational environment as possible.

Although the district is not liable for the safety of students who are not under school supervision, the school district can, and does, hold students accountable for their behavior from the time they leave their homes for school until they return to their homes from school, in the playgrounds and during recess, and while they are on school premises and/or under supervision of school district personnel. (Education Codes 44807, 44808)

Principals, teachers and bus drivers are responsible for the conduct and safety of students from the time they come under school supervision until they leave school supervision, whether on school premises or not.

The school district, Board members and district employees shall not be held liable for the safety and conduct of students who leave the school grounds as allowed by the Board's policy. (Education Code 44808.5)

A minor student shall not be released to leave school in the custody of a person other than the student's parent/guardian unless that person has the verified authorization of the parent(s)/guardian(s). Properly authorized law officers may seize or apprehend according to law.

It is the responsibility of the principal to provide for adequate supervision of playgrounds and other school facilities at all times they are in use by students during the school day or at school-sponsored activities. Special attention should be given to the prevention of accidents and to the development of habits of good citizenship.

The principal should make full use of the cooperative services of local and county organizations which provide safety services, such as fire, law enforcement and disaster preparedness agencies.

Missing Children

Consistent with district efforts to create a safe and secure environment for children and in order to assist in locating missing children, the Board recognizes that all employees of the district must be made aware of the plight of missing children. Each principal shall be responsible for seeing that information on missing children is posted in the school.

Eye Protection Devices

The Superintendent or designee is directed to develop regulations which require that eye protective devices are worn by students, teachers and visitors at any time when they are engaged in or observing an activity or using hazardous substances or equipment likely to cause injury to the eyes. (Education Code 32030, 32031)

The Board shall provide eye safety devices required by law at the district expense. (Education Code 32033)

Comprehensive Safety Plan

Development of School Site Safety Plan

The school site council shall write and develop a comprehensive safety plan relevant to the needs and resources of that particular school. The site council shall consult with local law enforcement in the writing and development of the plan, as well as other school site councils and safety committees, when practical. (Education Code 32281, 32282)

In addition, the school site council may consult with other local agencies as appropriate, including health care and emergency services.

The school site council may delegate the responsibility for writing and developing a school safety plan to a school safety planning committee. This committee shall be composed of the following members: (Education Code 32281)

1. The principal or designee.

2. One teacher who is a representative of the recognized certificated employee organization.

3. One parent/guardian whose child attends the school.

4. One classified employee who is a representative of the recognized classified employee organization.

5. Other members, if desired.

Elements of the Safety Plan

The districtwide and/or school site safety plan shall include, but not be limited to: (Education Code 32282)

1. An assessment of the current status of school crime committed on campuses and at school-related functions.

2. Appropriate strategies and programs that will provide or maintain a high level of school safety and address the school's procedures for complying with existing laws related to school safety, which shall include the development of all of the following:

a. Child abuse reporting procedures consistent with Penal Code 11164.

b. Routine and emergency disaster procedures including, but not limited to, adaptations for students with disabilities in accordance with the Americans with Disabilities Act.

Among the strategies for providing a safe environment, the plan may also include:

1. A positive school climate that promotes respect for diversity, personal and social responsibility, effective interpersonal and communication skills, self-esteem, anger management and conflict resolution.

2. Disciplinary policies and procedures that contain prevention strategies, such as strategies to prevent bullying and hazing, as well as behavioral expectations and consequences for violations.

4. Parent involvement strategies, including strategies to help ensure parental support and reinforcement of the school's rules and increase the number of adults on campus.

5. Prevention and intervention strategies related to the sale or use of drugs and alcohol which shall reflect expectations for drug-free schools and support for recovering students.

6. Collaborative relationships among the city, county, community agencies, local law enforcement, the judicial system and the schools that lead to the development of a set of common goals and community strategies for violence prevention instruction.

7. Procedures for responding to the release of a pesticide or other toxic substance from properties located within one-quarter mile of the school.

8. Procedures for receiving verification from law enforcement that a violent crime has occurred on school grounds and for promptly notifying parents/guardians and employees of that crime.

9. Assessment of the school's physical environment, including a risk management analysis and development of ground security measures such as procedures for the closing of campuses to outsiders, securing the campus perimeter, and protecting buildings against vandalism. In addition, methods for effective enforcement and prevention may be considered, including the presence of law enforcement on campus.

10. Crisis intervention strategies, which may include the following:

a. Identification of possible crises that may occur, determination of necessary tasks that need to be addressed, and development of procedures relative to each crisis, including the involvement of law enforcement and other public safety agencies as appropriate.

b. Assignment of staff members responsible for each identified task and procedure.

Emergencies And Disaster Preparedness Plan

All employees are responsible for promoting and providing for the safety of all students while under the jurisdiction of the school district. The Governing Board shall promote and provide for the safety of all employees while in performance of their assigned duties.

The following organization and line of authority shall exist during an extreme emergency:

Superintendent

Deputy Superintendent, Instruction Division

Assistant Superintendent, Operations

Chief Financial Officer

Assistant Superintendent, Human Resources

Assistant Superintendent, Instructional Support Services

Area Superintendents

The Superintendent or designee will have authority for the coordination of district personnel, students and property and shall be responsible for such.

All district staff and students must be prepared to respond immediately and responsibly to emergencies, disasters, and events which threaten to result in a disaster.

The Superintendent or designee shall develop and maintain a disaster preparedness plan which provides for handling all foreseeable emergencies and disasters and which shall also be adaptable for unforeseeable disasters. The plan shall be reviewed and updated at least annually.

Principals shall augment the district plan with working plans and procedures specific to each school building. All students and employees shall receive instruction regarding these plans.

The Superintendent or designee shall consult with city and/or county agencies so that district and site plans may provide the best possible way of handling each situation and also provide for emergency communications systems between these agencies and each district school.

The plans shall include, but not be limited to the following topics:

1. Fire in a building of the district.

2. Civil defense, with procedures in the event of bombing or land attack.

3. Bomb threat or actual detonation of a bomb.

4. Natural disasters, i.e., floods, heavy snows, blizzards, torrential rains, earthquakes, tornados.

5. Man-made disasters, i.e., smog, riots, airplane crashes, chemical accidents and weapon assault incidents.

6. Attack or disturbance by criminal or insane individuals or groups.

The Superintendent or designee shall provide a plan which allows bus seating capacity limits to be exceeded when a disaster or hazard requires students to be moved immediately to ensure their safety. (Education Code 38051)

The Governing Board shall grant the use of school buildings, grounds and equipment to public agencies, including the American Red Cross, for mass care and welfare shelters during disasters or other emergencies affecting the public health and welfare. The Board shall cooperate with such agencies in furnishing and maintaining whatever services it deems necessary to meet the community's needs. (Education Code 38132)

Disaster simulation exercises shall be held annually at each elementary school site and semiannually at each secondary school site and shall demonstrate how safety procedures may be applied to various types of emergencies.

The Board encourages all employees to become proficient in first aid and cardiopulmonary resuscitation. Each principal shall ascertain that at least one staff member at each school holds a valid certificate in these areas. The Superintendent or designee shall provide for CPR inservice training to be offered at least once a year for district staff.

Fire Drills

The principal shall cause the fire alarm signal to be sounded at least once every month. (Education Code 32001)

The principal shall also hold fire drills at least once a month at the elementary and intermediate level, and not less than twice every school year at the secondary level. (Education Code 32001)

Fires

When a fire is discovered in any part of the school, the following actions shall be taken:

1. The principal or designee shall sound fire signals, unless the school and/or building is equipped with an automatic fire detection and alarm system. (Education Code 32001)

2. The principal or designee shall call 911.

3. All persons shall be directed to leave the building and shall proceed outside to designated assembly areas.

4. Staff shall give students clear direction and supervision and help maintain a calm and orderly response.

5. In outside assembly areas, teachers shall take roll, report missing students, and provide assistance to any injured students.

6. In outside assembly areas, the principal, designee and/or each department head shall account for their staff, report missing staff, and provide assistance to any injured staff.

7. If the fire is extensive, students shall be taken to an alternate location for protective custody until parents/guardians can pick them up or until they ca be safely transported to their homes.

Bomb Threats

The following recommendations are made in order to minimize interruptions of school while recognizing the possibility that alarms may be factual. The principal must make the final decision as to whether or not the building should be evacuated for search.

Notify the Police Department (911) and the Superintendent or designee as soon as possible.

1. It is suggested that building personnel be alerted (low-keyed) to approach any visitors in the school building, secure their name (if possible) and refer the visitors to the office.

2. If it is necessary to evacuate the building, follow the routine evacuation procedure.

3. It is suggested that a team of school staff be formed to check all areas of the school. School personnel familiar with the school can quickly identify suspect items or objects and the rooms and areas can be checked quickly and efficiently.

a. A volunteer physical education instructor and other specialized teachers should be assigned to cover portion of the grounds with which they are familiar, paying particular attention to the physical education storage room area and locker room.

b. Custodial personnel should be assigned to appropriate areas of the buildings, such as, the boiler rooms, restrooms and storage rooms.

c. Office personnel should be assigned to inspect the administrative office suites.

d. The librarian should be responsible for checking the library.

e. The principal, in making these assignments, must ensure that someone is assigned to inspect every area of the school.

It is suggested that a checklist of these areas be used so that as each area is checked and clearance is provided to the principal, the students can be returned.

In the event a suspicious object is found, station a person out of the danger area, but as close as is reasonable, to warn others away from the general area. The assistance of the Police or Fire Department is to be requested immediately, and the Superintendent or designee is to be informed.

When a law enforcement agency becomes involved, they must be informed of the standard school procedure. In every instance, however, the dictates of the law enforcement agencies concerning search procedures in the building are to be followed.
